April 11th, 2025

The meeting was called to order at 8:30 by Commissioner Pancratz. Commissioner Goffena and Commissioner Turley were present. County Attorney Krakowka and Norma Trent were present for the day.

Pledge of Allegiance. Commissioner Goffena made the motion to approve the agenda as is. Commissioner Turley seconded. Motion carried.

Commissioner Turley made the motion table the Minutes from April 4th, 2025.  Commissioner Goffena seconded. Motion carried.

No Public Comment.

New Business:

  1. After review, discussion, Commissioner Goffena made a motion to deny the signing of the work order with Tetra Tech and abatement contractor for pre-shoring hazardous materials clean-up for the Wier Building Project. Commissioner Turley seconded the motion. Motion carried.
  2. Commissioner Turley made a motion to review and sign the Encroachment Permit for a water pipe in Sections 15 and 17, Range 11 North, Range 26 East, Colony Road submitted by Flatwillow Ranch. Commissioner Goffena seconded the motion. Motion carried.
  3. Commissioner Goffena made a motion to review, discuss underground electric powerline easement between Musselshell County and Northwestern Corporation, DBA NorthWestern Energy for Handel Park in the townsite of Musselshell.

Meetings:

Commissioner Turley attended a meeting with Headwaters to discuss validation facts around the Crow Revenue Act.

Commissioner Turley attended the Refuse Board Meeting. They discussed on-site staffing at the Roundup Transfer Station and reviewed cardboard removal.

Commissioner Goffena attended the Watershed Meeting. The Martindale Basin and Deadman’s Basin are nearly full.

Commissioner Pancratz attended the DES Mitigation Seminar. They reviewed the Musselshell County Community Mitigation Plans. Including fire and flood mitigation management.

Commissioner Goffena attended the Roundup Community Partners Meeting. They are currently raising funds for new playground equipment. Their goal is to raise $125,000.

Floyd Fisher, Refuse Board Member, came into discuss the Musselshell County website management, and cardboard disposal removal options.

Sheriff Lesnik gave his weekly report to the Commissioners. First Quarter numbers were reviewed. The department received 846 calls for service this year, up 78 calls over last year. Citations issued increased to 103 this year over the 54 citations issued last year. Corner calls are up 11 over last year, for a total of 15. Theft calls are down by half for a total of 15, Criminal Mischief calls are down by 14 for a total of 6, Medical calls have increased over last year by a total of 103 compared to 54 last year. The department was involved in a high-speed pursuit that ended with no injuries and no loss of property.

DES Director Justin Russell and DES Coordinator Darren Rook gave their update to the Commissioners. The Homeland Security Grant was submitted for $450K, it has not yet been approved but has been accepted. This Grant will pay for the West Repeater. The East Repeater has been submitted pending on DOGE review. CWPP compliance reports are complete. BLM conducted a fire mitigation prescribed burn on Thursday April 10-11th burning a total of 950 acres over the 2 days. This prescribed burn should keep fire mitigation for 30 years.

Treasurer Hetrick updated the Commissioners with properties coming up on tax deeds. They discussed reviewing all tax deed properties for environmental concerns before proceeding. They also reviewed the threshold currently in place for delinquent mobile home personal property tax is $200. The Commission is reviewing alternative options for getting funds rather than acquiring/seizing assets to pay taxes. Negative Cash balances were reviewed, including projects that didn’t have appropriations for.  The Goffena Bridge Project the remaining grant amount is $11,782 leaving the negative cash balance of $1,000 that will be taken from the Bridge Fund. Quarterly Reports have been completed. The Commission will review uncashed warrants, on a Resolution next week.

WWC met with the Commissioners to review Community Growth Policy and Capital Improvement. WCC has committed to putting together a Matrix of needs for County Projects which will generate a prioritized list for Capital Improvements. Over the coming weeks, WCC will reach out to all department heads to get Capital Improvement needs. The Community Survey will then be sent to the Commissioners for review and distribution with a Public Meeting to follow.

Theresa Doumitt met with the Commissioners regarding the status of the Wier Building project.
