The meeting was called to order by Commissioner Borner. Commissioner Goffena was present.

Also present was Mike Turley for the day.

Pledge of Allegiance.

Commissioner Goffena made the motion to approve the August 10, 2020 Agenda. Commissioner Borner seconded the motion. Motion carried.

Commissioner Goffena made the motion to approve the August 3, 2020 Minutes. Commissioner Borner seconded the motion. Motion carried.

There were no board meetings for the week. The Fire Council meeting was cancelled on Thursday August 6th, 2020. Commissioner Borner has a Central Montana Health District meeting on Thursday August 13, 2020 in Lewistown.

Commissioner Borner also spoke with Cathy Barta with Snowy Mountain Development regarding the ground water monitoring and they are looking into how long the monitoring will last.

Servpro has started the work on the Extension Office. They need to make sure they appropriate the funds in the budget to fix the bathroom. Maintenance Supervisor Jett has talked to Jeremy at Pioneer to do the work. Also Ms. Jett reported that the air conditioning at the Commons is fixed.

Mr. Donahue was given the flags for the cemeteries, so he will be working on the solar lighting.

They need to decide on how big of a building they want for the Courthouse storage issue.

Commissioner Borner has sent an e-mail to the Commissioners of Wheatland County regarding their lease agreement with FWP at Selkirk Fishing Access.

Maintenance Supervisor Jett is on vacation.

Road and Bridge Supervisor Stockert, Secretary Kenner, Weed Coordinator Beck, County Agent Fosjord and Fairgrounds keeper/maintenance Donahue met with the Commissioners to discuss the Fish Wildlife and Parks fishing access agreement at Riverside and how it will affect each department. Weed Coordinator Beck commented that once the weeds are under control it shouldn’t take more than a couple times a year to spray. Road and Bridge Supervisor Stockert said that he will volunteer his time on Fridays and the weekends to help build the site but would like to be able to use the County equipment. Commissioner Borner thinks that there needs to be some clarification on some of the areas of the agreement and mentioned that they had discussed possibly getting vaulted latrines at the campgrounds included in the agreement.

Road and Bridge Supervisor Stockert and Secretary Kenner gave their weekly report to the Commissioners. The Goffena Road Bridge replacement was discussed. They wanted MDT (Montana Department of Transportation) to address the old RR Bridge but they won’t because it is private property. Mr. Stockert ok’d the encroachment permit that is on the agenda. The call out procedure for fires needs clarified for all parties. The communication radio within the County has lots of static and miscommunication. They received an “Application Complete” letter for DEQ for the East District Gravel Pit.

Bill Edwards, Greg and Colleen Eislein met with the Commissioner regarding the Teddy Blue Abbott project and asked permission to look at the Courthouse yard to explore ideas of where the figure will fit best.

DES Coordinator Harper and Fire Warden Russell gave their weekly reports to the Commissioners. The State DES visited on Friday August 7, 2020 and the properties all looked great. They requested more information regarding the reimbursement. Mr. Russell reported that there were 2 fires last week one from a transformer and one lightning. They are going to need new people to man the fire staffing stations. They are working with the School District to move their office to the Old Wells Fargo building.

County Agent Fosjord gave her weekly report to the Commissioners. There is going to be a Noxious Weed Workshop August 27, 2020 at the Fairgrounds. Ms. Fosjord would also like to do an Ag Legacy Program in late September with the Yellowstone County Ag Agent and Carbon County Extension Agent. Ms. Fosjord would like to have a Fair board meeting August 18, 2020 if possible.

Veronica Meyer and Lonnie Fleck from Interstate Engineering et with the Commissioners regarding the issues with the Construction at the Airport. There has been a lot of miscommunication between all parties so we are going to have a weekly meeting on Mondays at 1:00 during the Commissioners meetings. Ms. Fleck introduced herself as the President of Interstate engineering and told the Commissioners that they are honored to be part of the Airport Project, they appreciate the business and want to work with the County with any issues. Commissioner Borner doesn’t want to have to commit to the shortfall of money when the County didn’t have anything to do with it. Commissioner Goffena said the County isn’t liable for the approximately $191,000.00. He thinks the engineer knew the fabric was there and should have stopped. Commissioner Borner asked if we can not do some of the alternates that were wanted to help with the cost? They are going to meet with the FAA and try to see if it is possible and also why the millings are not covered with extra money from them.

Public Hearing for the Preliminary Budget:

Mike Turley was present and Deb Adolph was present via GoToMeeting.

Clerk & Recorder Tomassi gave a sample of the mill levy worksheet but the numbers are not finalized yet. There were no comments and the meeting was recessed until August 17, 2020.

Commissioner Goffena made the motion to move item #5 on the agenda to the last item voted on. Commissioner Borner seconded the motion. Motion carried.

Commissioner Goffena made the motion to approve and sign the Encroachment permits for bore crossing/parallel line/communication line in Section 6, Township 7 North, Range 27 East on W. Parrot Creek Road submitted by Mid-Rivers. Commissioner Borner seconded the motion. Motion carried.

Commissioner Goffena made the motion to review and sign the Federal Financial Report for AIP 3-30-0066-014-2019 submitted by Interstate Engineering. Commissioner Borner seconded the motion. Motion carried.

Commissioner Goffena made the motion to review and sign the Outlay Report and Request for Reimbursement for Construction Programs for AIP 3-30-0066-014-2019 submitted by Interstate Engineering. Commissioner Borner seconded the motion. Motion carried.

Commissioner Goffena made the motion to review and sign the form for the Radio Replacement Project/Reverted Funds submitted by DES. Commissioner Borner seconded the motion. Motion carried.

Commissioner Goffena made the motion to approve and sign the Encroachment Permit for bore crossing/communication line in Section 25, Township 9 North, Range 25 East, Patterson Road submitted by Mid-Rivers. Commissioner Borner seconded the motion. Motion carried.

Commissioner Goffena made the motion review and sign Resolution 2020-25 Calling for the November 3, 2020 General Election to be Conducted by Mail Out Ballot. Commissioner Borner seconded the motion. Motion carried.

Commissioner Goffena made the motion to review and sign the Construction Agreement Checklist and Funding Agreement for the Goffena Road Project. Commissioner Borner seconded the motion. Motion carried.

Commissioner Goffena made the motion to review and sign the Request to the Federal Aviation Administration Airport AIP 3-30-0066-015-2020 Y 18-00-106.01 Grant amendment in the amount of $323,650.00 submitted by Interstate Engineering.  Commissioner Borner seconded the motion. Motion carried.

Commissioner Goffena made the motion discuss and sign Resolution 2020-24 Appointing Interim District 3 Commissioner. Commissioner Borner seconded the motion. Discussion Commissioner Borner said that when Tom Berry resign, the County Attorney issued an opinion that there should be no interim appointment. MACo disagreed.   The Musselshell County Republican Central Committee could put someone on the ballot in November. Now the County Attorney gave this Resolution to our secretary, without even a conversation with us to appoint Mike Turley as interim. Attorney Mike Meloy does not think we should fill the position. Mike Turley agrees to not fill the position. Commissioner Goffena made the motion to not pass Resolution 2020-24 Appointing Interim District 3 Commissioner. Commissioner Borner seconded the motion. Motion to not pass carried.

There being no further business the motion was made to adjourn.

Commissioner Goffena and Commissioner Borner did claims on August 6, 2020 in the amount of $259,292.08.
